U.S. Representatives Beth Van Duyne (R) and Greg Landsman (D-OH) introduced bipartisan legislation to establish federal regulations for hemp-derived beverages before a November 12, 2026, deadline threatens the legal marketplace.
The Beverage Regulatory Parity Act would create a three-tier distribution system, establish a nationwide 21-and-over standard, and impose testing, labeling, advertising, and THC requirements.
Rep. Van Duyne said the legislation would provide clarity for consumers and businesses while preventing hemp-derived beverages from being pushed into an unregulated market.

The bill would use a regulatory structure similar to the system that has governed alcohol distribution for decades.

The bill would also preserve the state's authority to establish additional restrictions or prohibit hemp-derived beverages entirely.
The proposal has recieved support from several beverage and hemp industry organizations, including the Texas Package Stores Association, Wine & Spirits Wholesalers of America, Total Wine & More, and the Hemp Beverage Alliance.
Texas Package Stores Association Executive Director Lance Lively said the legislation would protect children while allowing responsible adults to access legal products.
Rep. Greg Landsman also said the bill would allow businesses that have invested in hemp beverages to continue operating under clear rules.
