Randy Weber's PACK Act Advances, Targeting Conflicting Packaging Rules

A bipartisan effort to bring consistency to how recyclable, compostable, and reusable claims appear on consumer packaging is moving forward in Congress.

The House Energy and Commerce Subcommittee on Commerce, Manufacturing, and Trade advanced Congressman Randy Weber's (R) Packaging and Claims Knowledge (PACK) Act, H.R. 6832, to the full Energy and Commerce Committee.

The legislation would establish a uniform federal framework for voluntary recyclable, compostable, and reusable claims on consumer product packaging, replacing what supporters describe as a growing patchwork of conflicting state requirements.

Supporters say the differences can increase costs, complicate interstate commerce, and confuse consumers.

"Whether you're making a product, stocking a grocery store, or trying to figure out what in the world a label even means, you shouldn't need fifty different rulebooks," said Rep. Weber.

The subcommittee also adopted an amendment offered by Congressman Russ Fulcher (R-ID), a PACK Act cosponsor. The amendment further clarifies the role of Federal Trade Commission guidance and establishes minimum requirements for third-party certifications and certification bodies.

Fulcher said the legislation would address conflicting environmental claims while potentially lowering costs for consumers and families.

The PACK Act has received support from manufacturers, retailers, consumer product companies and trade associations. The PACK Act Coalition said the legislation could reduce consumer confusion, encourage informed purchasing decisions and promote better management of packaging materials at the end of their life.

The coalition includes organizations such as the U.S. Chamber of Commerce, National Association of Manufacturers and Consumer Brands Association, along with companies including General Mills, Kraft Heinz, PepsiCo and Nestle USA.
