Texas Attorney General Ken Paxton (R) has filed a lawsuit against ActBlue, accusing the major political fundraising platform of misleading consumers and enabling unlawful donation practices that could undermine election integrity.
According to the lawsuit, ActBlue allegedly failed to implement adequate safeguards to prevent foreign contributions. Paxton claims the platform's practices allowed ¨Straw donations" and other improper funding methods to flow into political campaigns, potentially violating both state and federal election laws.
"The radical left has relied on ActBlue as a way to funnel foreign donations and dark money into their political campaigns to subvert our laws," said Paxton. "ActBlue lied to Congress and to the American people, and I will ensure justice is served."
ActBlue, which primarily supports Democratic and progressive candidates, has processed more than $16 billion in donations since its founding in 2004.
The Office of the Attorney General first launched an investigation into the platform in 2023, followed by a 2024 petition to the Federal Election Commission, outlining concerns over potential donor fraud.
Despite ActBlue's claims that it strengthened its safeguards, Paxton's office alleges recent findings contradict those assurances. Investigators say the platform continues to accept gift cards and prepaid debit card donations, methods that can obscure donor identity and increase the risk of fraudulent or impermissible foreign contributions.
The lawsuit also cites reporting indicating that ActBlue's own legal counsel acknowledged inconsistencies in how donation safeguards were represented publicly.
The case marks a significant escalation in scrutiny over digital political fundraising platforms, with potential implications for campaign finance enforcement and election security nationwide.
