Attorney General Ken Paxton (R) is taking legal action against a New York official for allegedly obstructing the enforcement of a Texas court judgment against a doctor who mailed abortion-inducing drugs to a Texas resident.
This week, Attorney General Paxton filed a legal petition seeking a writ of mandamus against Taylor Bruck, the Acting County Clerk of Ulster County, New York.
The petition aims to influence Bruck to recognize and enforce a Texas court’s $100,000 judgment and permanent injunction against Dr. Margaret Carpenter.
In December 2024, Attorney General Paxton sued Dr. Carpenter after she allegedly mailed abortion drugs to a woman in Collin County, Texas.
According to the attorney general’s office, the medication resulted in the death of an unborn child and caused serious medical complications for the mother.
Speaking on the lawsuit in 2024, Attorney General Paxton commented that "in Texas, we treasure the health and lives of mothers and babies, and this is why out-of-state doctors may not illegally and dangerously prescribe abortion-inducing drugs to Texas residents."
The lawsuit resulted in a six-figure penalty and a court order prohibiting Carpenter from engaging in similar conduct in the future. However, when Texas attempted to enforce the judgment in New York, which is where Carpenter resides, Bruck’s office reportedly refused to authorize the collection of the penalty.
“Dr. Carpenter is a radical abortionist who must face justice, not get legal protection from New York liberals intent on ending the lives of as many unborn children as they can,” Attorney General Paxton commented in a statement. “No matter where they reside, pro-abortion extremists who send drugs designed to kill the unborn into Texas will face the full force of our state's pro-life laws.”
