Governor Greg Abbott (R) issued an executive order directing state agencies to take immediate action to restrict children's access to hemp-derived products. This follows the Legislature's failure to pass a THC ban earlier in the year.
"Texas will not wait when it comes to protecting children and families," Abbott said in a statement. "My executive order makes sure that kids are kept safe and parents have peace of mind now."
Under the order, the Department of State Human Services (DSHS), the Texas Alcoholic Beverage Commission (TABC), and the Department of Public Safety (DPS) must take steps to control sales to minors.
THC retailers will now be required to verify all government-issued identification for all purchases of hemp-derived products. Failure to do so may result in loss of their license. The DSHS is tasked with reviewing and revising current rules, including stricter testing and labeling standards, higher licensing fees, and improved record keeping.
State agencies will also work together on a study, exploring a broader regulatory frame work. They will take ideas from proposals like House Bill 309, which sought to establish a licensing and enforcement system for hemp-derived consumables.
Greg Abbott also emphasized the need to balance public safety with personal freedom.
"Consumers should know the products they purchase are tested and labeled responsibly," he said. "At the same time we are protecting the liberties of responsible adults."
Texas joins a growing number of states implementing executive action amid legislative standstills.
