U.S. Representative Chip Roy (R) has introduced the Preserving a Sharia-Free America Act. This bill would bar foreign nationals who adhere to Sharia law from entering or remaining in the United States.
The Bill aims to revise immigration policy to exclude individuals based on their adherence to religious legal frameworks viewed as incompatible with U.S. constitutional principles.
Roy described Sharia law as "an existential threat," citing concerns over what he saw as its impact on women, children, and religious minorities.
He referenced Europe as a cautionary example, claiming that Sharia's spread there has contributed to what he views as the erosion of Western values.
"From Texas to every state in the union, instances of Sharia Law adherents have threatened the American way of life, seeking to replace our legal system and Constitution with an incompatible ideology that diminishes the rights of women, children, and individuals of different faiths," said Roy.
The legislation proposes to deny any visa, immigration benefit, or relief to foreign nationals who adhere to sharia law. It would also revoke immigration benefits or relief already granted to those found to be adherents to the designated group.
According to the legislation, any foreign national who makes a false statement about their adherence to Sharia law would be deemed inadmissible and subject to removal. Additionally, the bill seeks to limit the ability of courts to overturn decisions by federal agencies that determine an individual is removable on these grounds.
The legislation is expected to face significant legal and constitutional scrutiny, particularly regarding its potential conflicts with religious freedom protections under the First Amendment.
