Trinity Couriers Inc. has pleaded guilty to fraudulently obtaining workers' compensation insurance coverage, agreeing to pay $800,000 in restitution to Texas Mutual Insurance Company.

An investigation by the Texas Department of Insurance's Division of Workers Compensation (DWC) found that between 2016 and 2018, Trinity Couriers engaged in a scheme to underreport payroll to lower its insurance premiums.

According to the investigators, Trinity Couriers is one of several delivery service companies under the common control and ownership of Mike Miller of Miller Transportation Management.

These affiliated businesses were required to be disclosed to their insurance provider, but Trinity Couriers failed to do so, defrauding Texas Mutual of accurate premium payments for their coverage.

Jessica Bergeman, the DWC prosecutor embedded within the Travis County District Attorney's Office, secured the conviction.

"Requiring the system participants to act with honesty and integrity in their business dealings ensures the ongoing viability of the Texas workers' compensation system to protect injured workers," said Bergeman.

The Division of Workers' Compensation oversees the state's workers' compensation system, facilitates dispute resolution between employees and insurers, and provides safety and health services to help Texas employers create safer workplaces.
