New information has emerged in the legal battle over House Bill 21 (HB21), the controversial overhaul of Texas's affordable housing framework. A coalition of affordable housing developers, including the Texas Housing Coalition (TWHC) and Post WB Apartments, LLC, has already sued the Bexar Appraisal District, arguing that HB21 violates the Texas Constitution and threatens billions in long-standing affordable housing investments.
However, a recent filing now raises significant questions about potential conflicts of interest behind the legislation itself.
An organization called Concerned Property Tax Payers of Texas (CPTP) has filed a petition to intervene in the litigation. According to the filing, one of the CPTP's members is APTBP, LLC, an entity whose director and registered agent is Representative Gary Gates, the lawmaker who spearheaded HB21.
This revelation is notable because developers have long accused Gates, a prolific landlord and Property Owner across Texas, of pushing HB21 in ways that benefit his own real estate portfolio.
APTBP owns Bay Pointe Apartments in Baytown, a complex positioned to gain from HB21's impact on competing affordable housing developments whose tax-exempt status is now in jeopardy.
The underlying lawsuit argues that HB21 unlawfully rewrites existing contracts by revoking tax exemptions granted under "Old Chapter 394," the state's decades-old housing partnership framework.
Appraisal districts such as Bexar have already begun reversing exemptions even though the law does not fully take effect until 2027, a move plaintiffs say is unconstitutional and destabilizing. Trey Cox, attorney for the developers, previously warned that HB21's retroactive changes "violate the rule of law," and could displace working-class families statewide.
The new filing adds a political dimension to the fight, raising questions about whether the legislation's architect stands to profit from its implementation.
